Reconsider banning TikTok

In a surprising turn of events, the government announced a ban on the popular social media platform, TikTok, on the eve of Tihar-- the second greatest festival of Hindus across the country. This decision taken by the cabinet on November 13 in the name of preserving social harmony has sparked deep concern and disappointment among citizens and various stakeholders, including this newspaper. The Supreme Court is expected to pass a verdict in response to several writ petitions filed against the government's decision early next week based on the existing constitutional and legal provisions. As a newspaper, we firmly believe that this ban is not only untimely and arbitrary but also a serious violation of the freedom of  expression guaranteed by the Constitution of Nepal, 2015. Article 19 of the Constitution explicitly prohibits censorship of news items, editorials, features, or any form of communication, including electronic publication. However, it also allows for the formulation of legislation to regulate radio, television, online platforms, or any other digital or electronic means of communication. This provision recognizes the need for regulations that ensure responsible and ethical use of these platforms without compromising the principles of democracy. TikTok, in a short span of time, has become a global sensation and has been embraced by people of all ages, backgrounds, and socio-economic strata in Nepal. This serves as a platform for information, education, entertainment, and inspiration.

The abrupt decision to put a ban on TikTok is not just a blow to the users but also has severe economic consequences, particularly for Nepali content creators and businesses that heavily rely on the platform for marketing and sustaining their operations. In response to concerns about its content and safety measures, TikTok has communicated with the Nepal Telecommunication Authority (NTA)-- the government regulatory body of internet service providers-- and has expressed readiness to further strengthen collaboration with the government to address its concerns, highlightings its previous collaborations with various government bodies in Nepal. These include detailed presentations to the Ministry of Home Affairs Committee for Cyber Crime Control and Cyber Security, conducting an Internet Safety Summit in Kathmandu, signing an MoU with NTA for an internet safety awareness campaign, and actively removing millions of videos violating community guidelines. The platform has also opened up its 'Trust and Safety Enforcement Tool' to the Government of Nepal, registered as a Digital Service Tax payer, and engaged in workshops to enhance the understanding of its operations among government officials. These initiatives demonstrate TikTok's commitment to collaborating with the government to ensure social harmony and user safety.

As a newspaper we believe that the abrupt ban on TikTok contradicts the ongoing engagements between TikTok and the Government of Nepal. The platform has shown a willingness to address concerns and work towards a resolution that aligns with the interests of both parties. Blocking a widely used platform for creative expression undermines the principles of freedom of speech and expression, a cornerstone of democracy. In light of TikTok's proactive measures and commitment to cooperation, we urge the government authorities in Nepal to reconsider their decision. Rather than imposing a blanket ban, the government should explore the option of introducing new legislation that aligns with democratic principles and strengthens the partnership between the government and TikTok for responsible content regulation. This approach ensures the protection of civil liberties, upholds democratic values, and fosters a collaborative environment for the benefit of all stakeholders involved.
