The government had withdrawn the old citizenship bill from the House of Representatives and the National Assembly and registered a new one to solve the citizenship problem. The bill was passed by a majority and sent to the President for certification.

However, President Bhandari sent the bill back to the parliament. The returned bill was again passed by the ruling coalition and sent for certification. But the President did not certify the bill within the mandatory 15 days, thereby nullifying the bill. Claiming that the President's act was unconstitutional, a writ petition was filed in the Supreme Court on September 21.
