Advocate Sunil Ranjan Singh and chairman of the ad hoc struggle committee to protect the rights of civil servants at Bir Hospital Shobha Chandra Mishra moved the SC against the decision.[break]
The petitioners have argued that the decision of the hospital is illegal and unconstitutional. They have stated that the poor people in need of medications would be the hardest hit by the decision to increase the charges. Also, the petitioners have claimed that the hospital took the decision without any prior notice.
The hospital has said that revision of charges was long overdue as it has not been revised since the last 20 years. A meeting of the hospital´s executive board held in January had decided to hike the charges for beds, pathological and radiological services and other diagnostic care.
The government provides more than Rs 400 million in grant to the hospital every year. The hospital´s Executive Director Dr Bulanda Thapa, its vice-chancellor and executive board as well as the Ministry of Health and Population are made defendants in the petition.
