Patan Appellate Court 'well on course to meet case settlement target'

KATHMANDU, March 30: The Patan Appellate Court has claimed that it is well on course to meet the target of case settlement for the fiscal year 2014/2015.

Organizing a press meet on Monday, the appellate court has informed that it settled 4,579 cases in the first eight-and-half months of the ongoing fiscal year. According to Deputy Registrar of the court Bed Prasad Upreti, case settlement currently stands at 94.78 per cent.


As per the Strategic Plan of the judiciary, Patan Appellate Court is to settle 60 per cent of the total cases registered in the court. As per the target, the court was to settle 4,831 cases in the first eight-and-half months of the fiscal year.

However, the settlement percentage is only 44.78 of the total cases, including the backlog cases.

On the other hand, the court still has 202 cases pending for more than two years. Likewise, there are 462 cases that have remained unsettled for a period of more than 18 months.

Deputy Registrar Upreti said lack of human resources and infrastructures at the court are major challenges of meeting the target set by the strategic plan.

Meanwhile, success of the court-recommended mediation at the appeal court is very low.

According to Upreti, only 42 cases were settled through mediation though a total of 446 cases were recommended for mediation. He informed that 71 cases are still going through the mediation process.

"People come to the appellate court to challenge the verdicts of the lower court. The party to any case, who has benefited or won a case in the lower courts, is generally unwilling to seek mediation. However, we recommend cases for mediation," said Giriraj Paudyal, chief judge of the Patan Appellate Court.
