The company accused the government of violating its constitutional and legal right to confidentiality by making sensitive and confidential information contained in the report public.
Ncell claimed that the disclosure breached the confidentiality of property, documents, data, transactions and electronic records guaranteed under Article 28 of the Constitution and the Privacy Act, 2018. The company also said the confidentiality of taxpayers protected under the Income Tax Act and Value Added Tax Act had been compromised.
Ncell warned that the decision to publish the report could send a negative message about Nepal’s foreign investment environment and undermine investor confidence.
The company also said the government’s move had caused irreparable harm to Ncell, its shareholders, directors and beneficiaries.
