NBA, which decided not to submit facts and evidences related to corruption in the judiciary to the secretariat, has finalized the content of the letter on Wednesday. "We'll submit the letter to the personal secretariat of the chief justice on Thursday," informed Sunil Kumar Pokharel, general secretary of NBA.As NBA declaration included an appeal to Judicial Council to take action against the corrupt judges and judicial staff, the secretariat asked Nepal Bar Association to clarify it and provide facts and evidences if they have any.
According to Pokharel, the NBA has clarified that the declaration was not an individual view but a collective response of the lawyers across the country. "Our response letter will stress that the NBA would readily support any inquiry of Judicial Council and parliament if they set up mechanisms to investigate corruption within judiciary," said Pokharel. "However, the letter will clearly state that facts and evidences of corruption could not be submitted since only Judicial Council and the Parliament only have the right to take action against judges," he added.
The personal secretariat of Chief Justice Ram Kumar Prasad Shah on Friday had sent letters to NBA Chairman Hari Krishna Karki and advocates Tikaram Bhattarai and Raman Shrestha to clarify the declaration.
