KMC bans unauthorized leasing of govt land within metropolis

KATHMANDU, July 7: The Kathmandu Metropolitan City (KMC) has enforced a ban on the leasing of government land within its jurisdiction without prior permission from the metropolis. Mayor Balendra Shah made the official announcement on Thursday via Facebook, emphasizing that any land lease executed without the metropolis' approval would not hold legal recognition.

The metropolis has cited the provisions outlined in the Local Government Operation Act, 2074 BS, under Section 97, subsection 1, that clearly say that the Council of Ministers can lease government land only with the recommendation of the local government concerned.

Furthermore, in accordance with the Property Act, 2034 BS, and the Policy on Registration, Use, and Leasing of Government Land issued under subsection 1 of Section 24, the Council of Ministers can lease land solely upon the recommendation of the local government concerned.

Expressing concern over the unjust leasing of government land within the KMC area for personal gain without coordination or proper communication with the metropolis, Mayor Shah highlighted that such actions violate the existing laws. He emphasized that government land reserved for public or governmental purposes should not be leased to individuals, entities, or organizations without adhering to the required protocols, including seeking approval from the Executive Council of KMC.

Mayor Shah underscored KMC's commitment to safeguarding government land, which falls under the rightful ownership and control of the Government of Nepal. He urged all stakeholders to refrain from engaging in activities that contravene the prevailing laws and warned that decisions made on leases violating the regulations would not be legally recognized.

Furthermore, he clarified that no house designs would be approved for government land acquired or leased without the metropolis' recommendation. Additionally, no authorization would be granted for the construction of any physical structures without proper approval.
