Hearing on writ petition against Koshi CM to be held on Sunday

KATHMANDU, Sept 1: The hearing on the writ petition against the Koshi government will be held on the 3rd of September.

The hearing scheduled for Friday (today) was adjourned after Justice Ishwar Prasad Khatiwada refused to conduct the hearing.

According to Govinda Prasad Ghimire, information officer of the Supreme Court, the adjourned hearing will be conducted on the 3rd September, Sunday. Ghimire also said that on the 3rd, Justice Ishwar Prasad Khatiwada will be in a single bench.  

On the 24th of August, the Khatiwada bench had ordered that the person presiding over the Provincial Assembly meeting should not take long-term and policy decisions saying that it was unconstitutional to vote in favor of the motion of confidence.

Before that, on 21st August, Chief Minister Uddhav Thapa had announced that the vote of confidence was obtained by using the vote of the Speaker in the Koshi Province Assembly and former Chief Minister Hikmat Kumar Karki had filed a petition in the Supreme Court saying that this was unconstitutional.

Koshi Chief Minister Thapa submitted a written reply to the Supreme Court last Wednesday. He claimed that the vote of confidence taken from the provincial assembly was in accordance with the constitution and submitted the argument that the government had taken the vote of confidence according to Article 188 of the constitution and submitted a written reply saying that the person who presided over the meeting can vote according to that article.
