The writ was initially filed by Advocate Anupam Bhattarai on May 27, demanding that Lamichhane be suspended and an investigation initiated against him for his alleged involvement in cooperative fraud.

On June 21, the lawyer for the petitioner presented arguments. A bench comprising Justices Sapana Pradhan Malla and Saranga Subedi then scheduled the next hearing for July 2, as arguments on behalf of Home Minister Lamichhane were still pending. However, even after the scheduled hearing, the justices are yet to reach a conclusion.

Bhattarai's petition requests an interim order from the Prime Minister and the Council of Ministers to suspend Lamichhane from his position, arguing that his continued tenure could unduly influence and negatively affect the investigation process.
