Follow RTI act for classifying info: SC to govt

KATHMANDU, Sept 10: Supreme Court on Thursday has issued mandamus order to the government not to bar the dissemination of other information than those mentioned in the Right to Information Act in the list of classified information.

The special bench of Justices Girish Chandra Lal, Deepak Raj Joshi and Gobinda Kumar Upadhyaya urged the government that Clause 3 of the Act has clearly mentioned about the classified information.The government led by Baburam Bhattarai had listed 140 types of information as classified information by misusing the Clause 27 of the Act, which has a provision regarding classification of information and forming a committee to classify the information.

Clause 3 of the act has a clear provision of not disseminating that information, which seriously jeopardizes the sovereignty, integrity, national security public peace, directly affects the investigation of a crime, seriously affects on the protection of economic or trade privacy, jeopardizes the harmony among communities and interferes on individual privacy.
