KATHMANDU, May 14: A complaint has been lodged against Kaski District Court Judge Lal Kaji Shrestha following his order to release a rape-accused despite having evidence to prove the offense.
The victim filed the complaint against the judge at the Judicial Council, the constitutional body that monitors the conduct of judges, accusing him of granting bail to the rape accused Sundar Kumar Shrestha on April 29 although the evidences clearly showed his involvement in the crime. Judge Shrestha had released the rape accused on a bail of Rs 500,000. Sources at the judicial council informed Republica that it will probe into the case.

The rape accused has been facing allegations of raping a 16-year-old girl of Pokhara. The petitioners have sought maximum punishment against the rape accused as per the existing laws of Nepal.
Judge Shrestha has been facing allegation of granting bail to the rape accused by twisting the facts and misinterpreting the law.
While granting the bail, Judge Shrestha has stated that though the collected evidences initially proved the crime committed by the accused he can be granted bail before the final hearing decides the case.
The victim girl filed the petition at the JC stating that it was a serious negligence on part of the judge who violated the judicial norm by granting bail to the accused when the collected evidences already proved the offense. The petitioner also drew the attention of Chief Justice Cholendra SJB Rana to take action against the judge.
