Speaking at a function organized by the Judicial Council, Shrestha said, “Constitutional Court can curtail Supreme Court (SC)´s jurisdiction. As such a court is not in the interest of independent judiciary, we must oppose it.”[break]
He said some elements that are against the independence of judiciary are attempting to incorporate provisions related to Constitutional Court in the new constitution.
“I was personally suggested by Russian Chief Justice not to accept constitutional court in the new constitution,” he said, adding, “Such a court has already been proved ineffective in Russia.”
Chief Justice Shrestha also cautioned justices about possible attack on the Judicial Council. “I urge all justices and officials of the judiciary to unite against any possible attack on the judiciary,” he said.
Speaking at the same function, senior-most justice of the Supreme Court Kheel Raj Regmee urged judges and intellectuals to stand united to protect judicial independence.
Meanwhile, speaking at a function jointly organized by the Office of Prime Minister and the Administrative Court, Chief Justice Shrestha stressed on the need to ensure efficient and prompt delivery of justice.
Similarly, Justice Regmee asked government officials to be accountable, transparent and sincere while conducting their duties. “We should prioritize our responsibilities,” he said, adding, “Service seekers should not only get services from the judiciary in a hassle-free manner but also from other state agencies.”
Another SC Justice Kalyan Shrestha expressed dissatisfaction over the written clarification being furnished by government officials. “There is need to train government officials on how to furnish written clarifications to the SC,” he said, adding, “Most of the written clarifications furnished by government officials are meaningless.”
Justice Shrestha said, “Court verdicts, orders and decisions must be implemented by government officials without delay. Government cannot be considered as a real government if it doesn´t implement court decisions.”
SC Justice Shrestha, OPMCM Secretary Lila Mani Paudyal and Professor Dr Bhim Dev Bhatta had presented their papers at the function.
