CA panel lists jurisdictions of center, federal states

KATHMANDU, Oct 11: The CA committee on State Restructuring and Sharing of State Powers has finalized the lists of jurisdictions of central, provincial and local governments in the new constitution. [break]



The CA committee has also prepared a concurrent list as common jurisdiction of central and provincial governments. "The committee has finalized the lists," Thakur Prasad Baral, secretary of the committee, told myrepublica.com.



The committee has proposed that the central government oversee the defense and the army issues, the province look after police, administration, peace and security, and local government oversee municipal police and community police.



The committee has proposed that the central government look after the central banks and formulate financial policies, monetary policy and foreign aids, support and loans.



As per the concept, policies about international trade and commerce, exchange rates, airports, quarantine, international as well as interstate civil aviation, foreign policy, international treaties, extradition, international border, national intelligence, supreme court, constitutional court, citizenship certificates, passports and visa policies will be formulated by the central government.



Likewise, the Election Commission, National Human Rights Commission, Commission for the Investigation of Abuse of Authority and Public Service Commission, among others, will fall under the jurisdiction of the central government. But there will be a few commissions at the provincial level as well.



Provincial governments will look after provincial railways, highways, courts, provincial development projects, health services, land management, land revenue, protection and use of language, culture, script and religion of the region, forest and water resources in the province, agriculture, livestock development, trade and commerce, transport management, production and sale of alcoholic items, among others.



Similarly, the local governments will look after issues relating to local taxes (on property, house rents and transportation etc), service charges, and tax on tourism and advertising and land revenue. They will also receive royalty on natural resources, look after local services, and maintain and manage local statistics, local development projects, basic health and sanitation facilities, local markets, local roads, small irrigation projects and local courts.



The central government will run central universities and central libraries. Provincial government will run other universities, higher education, libraries and museums while the local government will be responsible for primary and secondary level education.



Several issues have been included in the concurrent list as common jurisdiction of the central and provincial governments. The list includes supply, distribution, price and quality control of essential goods, security related issues, family matters like marriage, property handover, divorce and issues relating to minorities, orphans and joint family matters.



National and interstate environment management, use of forests, wild animals, flora and fauna, mountains, water resources and national parks that spread across the provinces have also been included in the concurrent list.
