The former police chief has been convicted of corruption some 15 years after his retirement during which he has joined the Nepali Congress party. [break]
The Special Court verdict was handed down by Judges Gauri Bahadur Karki, Om Prakash Mishra and Kedar Prasad Chalise. The case was reinstated by the Supreme Court six months ago.
The Supreme Court had ordered the Special Court to resurrect the case, nullifying the latter´s decision to quash it on the basis of statute of limitations.
A similar corruption case involving Achut Krishna Kharel, Bohara´s immediate successor as IGP, is also about to be wrapped up by the Special Court, with a final hearing due on Wednesday. The Special Court had re-opened the corruption cases of both Bohara and Kharel following the Supreme Court order of November 11 to do so, citing grounds of merit. The CIAA had moved the courts against them simultaneously.
This is the second time in a year since the Sudan scam that a former police chief has been convicted of a corruption charge.
The Special Court said in its verdict that of the total property amount of Rs 8.98 million found to be owned by Bohara, a portion worth Rs 2.68 million did not correspond to his income sources. The amount involved in corruption will be recovered from Bohara family property.
Bohara has been convicted as per the Corruption Control Act 2059 BS.
The CIAA had filed case with the Special Court claiming Bohara was found to possess a colossal amount of property worth Rs 23.8 million and was not revealing the source of the property.
The CIAA had built up the case on the basis of a report of the ´Judicial Commission for Probing Properties´.
Bohara can still take recourse to the Supreme Court.
