A division bench of Justices Ram Kumar Prasad Shah and Prakash Wasti issued such an order staying the government´s decision till the court´s final verdict, saying that the government´s decision was faulty and violated the existing Police Service Regulation. The apex court has also questioned the marks given to five SSPs for promotion. "The marks given to the promoted SSPs should have been based on competence, academic qualifications and seniority as per the regulation," stated the SC order.[break]
A single bench of Justice Damodar Prasad Sharma on December 24 had stayed the government´s decision till December 31.
Challenging the government´s decision, SSPs Ravi Pratap Rana, Purna Singh Khadka, Manohar Prasad Rimal, Ram Kumar Khanal, Tara Prasad Lamichhane and Gyanod Raj Upadhyaya on December 23 had moved the apex court claiming that the government´s decision violated the existing Police Service Regulation.
A cabinet meeting held on December 19 had promoted SSPs Shyam Bahadur Khadka, Navraj Silwal, Praksh Aryal, Jaya Bahadur Chand and Bam Bahadur Bhandari to the post of DIGs.
The petitioners have claimed that except Khadka, the rest of the promoted officers are junior to them. The Prime Minister´s Office, the Ministry of Home Affairs and the police headquarters, among others, have been made the defendants.
