SC upholds stay order on SSPs' promotion

KATHMANDU, Jan 1: The Supreme Court (SC) on Tuesday has stayed the government decision to promote five Senior Superintendents of Police (SSPs) to the post of Deputy Inspector of Generals (DIGs), asking it not to implement the decision until the court gives a final decision.



Saying that the government decision was a fault, the apex court decided to give continuity to its earlier stay order and also directed the government to keep the decision on hold. [break]



After a hearing on a petition filed by disgruntled SSPs Rabi Pratap Rana, Purna Singh Khadka, Manohar Prasad Rimal, Ram Kumar Khanal, Gyanodraj Baidya and Tara Prasad Lamichhane, a joint bench of bench of Justices Ram Kumar Prasad Sah and Prakash Wasti issued the order to this end today.



Earlier on December 24, the SC had issued an interim order in the name of defendants, directing the government to stay the decision until December 31.



Demanding that the decision be scrapped as it was against the ´hierarchy of seniority´, they had filed a petition on December 23. The petitioners had also claimed that promoted officers except Khadka are junior to them.



The Council of Ministers on December 19 had decided to promote the SSPs Shyam Bahadur Khadka, Nawaraj Silwal, Prakash Aryal, Jaya Bahadur Chand and Bam Bahadur Bhandari to DIGs.
