330 civil servants file writ petition against adjustment ordinance

KATHMANDU, Jan 7: A group of 330 civil servants have jointly filed a writ petition at the Supreme Court Sunday challenging the Civil Servants Adjustment Ordinance. The government had recently brought the ordinance to facilitate adjustment of civil servants in the federal, provincial and local governments.

The petitioners seek a court order to stop the adjustment process.

The Office of the Prime Minister and Council of Ministers, the Ministry of General Administration and Federal Affairs have been named as defendants in the petition.

The apex court has scheduled its initial hearing on Friday. The petitioners have claimed that the ordinance promulgated on December 9 contradicted the Civil Service Act and violated the fundamental rights as ensured by the constitution of Nepal.

The government had issued the ordinance on December 9.

Altogether 119,069 civil servants have already filled applications online, expressing their interest for the adjustment. Over 34,000 civil servants have updated their personal details, the prime minister told the parliament on Sunday.
