Taking up a public interest petition filed by a group of lawyers affiliated with the Democratic Lawyers´ Association, Chief Justice Khil Raj Regmi issued the ruling and ordered defendants and plaintiffs to be present before the apex court on January 25. [break]
The apex court said it would discuss with lawyers representing both defendants and plaintiffs whether or not to continue with the stay order until the case is finalized.
Stating that the case is a complex one and of public importance, the chief justice ordered the court to bring the case before a full bench of three or more justices, on January 25.
In a controversial decision last week, the cabinet decided to legalize conflict-era property transactions that took place under Maoist people´s governments, and to waive the registration fee in the legalization process.
But the main opposition parties have taken strong exception to the decision and declared that they would not hold any meetings with the Maoist party nor let parliament run until the decision is withdrawn.
They have accused the Maoist-led government of trying to legalize the work of their people´s governments of the conflict era. But Land Reform Minister Bhim Prasad Gautam said the decision was necessary to address the issue of land transactions that took place under the Maoists.
