A single bench of Justice Girish Chandra Lal ordered the court administration to register the review peittion. The peittion was filed by Chief Secretary Lilamani Poudel on behalf of the government on May 21.
The apex court had issued a verdict ordering annulment of some of the controversial provisions of Truth and Reconciliation Commission (TRC) and Commission to Inquire on Enforced Disappearance (CIED) Act in February. Sunday's order has paved the way for hearing on some annulled provisions of the act.A joint bench of Justice Kalyan Shrestha, Baidya Nath Upayadhaya and Cholendra Samser Rana had ordered annulment of some of the provisions in the act that contradicted with international laws and human rights principles.
The Maoist parties had been demanding a review of the verdict, saying it was against the spirit of the peace process. The government had also agreed with various Maoist parties to seek review of the apex court verdict.
However, SC had declined to register the review petition filed by the office of the Attorney General (AG) last week. The office of the AG had then registered the review petition at the bench.
The SC's had annuled some of the provisions of the act in February responding to the petition filed by 234 conflict victims, who claimed that the act aims to provide general amnesty even for serious human rights violations.
The SC had ordered to annual various controversial provisions in the TRC and CIED as demanded by the confict victims. UCPN (Maoist), CPN-Maoist, CPN Maoist and other Maoist parties have expressed serious dissatisfaction after SC's verdict prevented sub-judice cases from being transferred from regular courts to transitional justice mechanisms.
