Advocate Ramesh Kafle had filed a writ petition at the apex court seeking the court's order for preventing Gurung from working in the capacity of a commissioner in the anti-graft body.
A joint bench of justices Sushila Karki and Devendra Shrestha refused to issue stay order in the case.
Earlier, a division bench of Chief Justice Kalyan Shrestha and Justice Jagdish Sharma Poudel had sought documents from Gurung after the writ petitioner claimed that she is taking double perks and incentives as she is an associate professor at Ratna Rajya Laxmi Campus of the Tribhuvan University.
CIAA on January 6 had relieved Gurung of her responsibilities temporarily after she was dragged into controversy.
A meeting of commissioners of the CIAA had taken the decision as the case accusing her of enjoying double benefits as commissioner and professor was sub judice. With the court's latest decision, she can resume her work at the CIAA until the court gives a verdict on the issue.
Gurung was overseeing cases of irregularities and corruption related to the Ministry of Foreign Affairs, Ministry of Physical Infrastructure and Transport, Ministry of Defense, Ministry of Commerce and Supply, Ministry of Urban Development, and Ministry of Irrigation. Likewise, she was also given responsibility to administer cases of corruption in Central and Far-western Development Regions.
