KATHMANDU, Jan 17: Sher Bahadur Deuba-led faction of the Nepali Congress (NC) has decided to challenge the Election Commission’s (EC) decision in the Supreme Court (SC), a day after the poll body granted official recognition to the NC faction led by Gagan Thapa.
Speaking after a meeting of Central Working Committee (CWC) members aligned with Deuba on Saturday, senior leader Dr Prakash Sharan Mahat said the faction had rejected the EC’s ruling and resolved to seek judicial redress. Mahat said the decision was “unconstitutional,” “one-sided,” and driven by “malafide intent.”

Announcing their decision, Dr Mahat said the EC’s move undermined the duly elected CWC of the country’s largest democratic party and formed part of a broader conspiracy to derail the democratic order. “This meeting concludes that the decision, taken unilaterally without even considering attendance numbers, is motivated by ill intent. It is part of a conspiracy to push the country’s democratic system toward an accident,” he said.
Dr Mahat also complained that the EC failed to provide the Deuba faction an opportunity to present its clarification. “The Commission did not even call us, nor did it fulfil the basic formality of hearing our side,” he said, adding that the ruling ignored established precedents, the party statute, and election laws.
Stating that the faction would pursue both legal and political remedies, Dr Mahat said preparations were underway to approach the SC on Sunday. “The Supreme Court is our final forum for redress. We will move the court tomorrow against this decision. We are confident justice will prevail and a stay order must be issued,” he said.
