Hearing of Karki case deferred

KATHMANDU, April 9: The hearing of a writ petition filed at the Supreme Court against the proposed appointment of former chief secretary Lokman Singh Karki as chief of the Commission for the Investigation of Abuse Authority (CIAA) has been further deferred, on Tuesday.



A division bench of Justices Damodar Prasad Sharma and Sushila Karki was to conduct the hearing of the petition earlier filed by advocate Om Prakash Aryal. Hemanta Rawal, deputy spokesperson of the apex court, informed of the postponement of today’s hearing for technical reasons. [break]



According to Rawal, Justice Sharma was not eligible to carry out hearing in the case in which the Constitutional Council (CC) has also been made one of the defendants as Sharma himself is an ex officio member of the CC. The hearing will now take place next week.



Earlier on Sunday, the hearing was deferred as it emerged that advocate Prasanna Krishna Das, who was also pleading on behalf of the petitioner, is related to Justice Ram Kumar Prasad Shah. It is a universal practice that a judge refrains from conducting hearing in a case if the lawyer or either of the disputing parties in the case is related to the judge.
