Pleading before the five-member bench headed by Chief Justice Khil Raj Regmi and including senior Supreme Court Justices, Karki said that the government and the Constituent Assembly (CA) must prove the legitimacy of their argument if they want to extend the CA´s term any further.[break]
"If the government and the CA fail to prove such legitimacy, they cannot extend the CA´s term," he said, adding, "If they extend the term without proving legitimacy, that can be tested at the Supreme Court."
He also said that the government does not seem to be responsible towards the CA. "The Supreme Court must say clearly whether or not the CA can extend its term any further," he said, adding, "The CA does not enjoy the right to extend its term for four years, going beyond its initial two-year term."
Senior Advocate Karki also argued that the Supreme Court can test matters if the CA extends its term citing the doctrine of necessity. Karki was pleading before the special bench as part of an amicus curie appointed by Nepal Bar Association at the request of the Supreme Court.
Another advocate, Tikaram Bhattarai, also pleaded before the bench as part of the amicus curie. The hearings on the writ petition challenging the legitimacy of CA term extension are continuing at the apex court.
