KATHMANDU, Nov 11: The Supreme Court (SC) has issued an interim order preventing the government led by Madhesh Province Chief Minister (CM) Saroj Kumar Yadav from making any long-term or policy-level decisions.
A single bench of Justice Tek Prasad Dhungana issued the order on Tuesday while hearing a writ petition filed by law student Rocky Prasad Sah and others.
The order states that since questions have arisen regarding the interpretation of Article 168 (2), (3), and (4) of the Constitution of Nepal, CM Yadav and the Council of Ministers formed on his recommendation should refrain from taking any long-term decisions until the final verdict is delivered.
The apex court has also given the case a priority hearing, noting its constitutional and public significance. The final hearing is scheduled for November 27, 2025, along with a related writ (082-WO-0409) filed earlier by 74 provincial assembly members.
Earlier, former Madhesh Province Chief Sumitra Subedi Bhandari had appointed Yadav as Chief Minister under Article 168 (3) of the Constitution.
