Govt mulling ordinance for constitutional posts

KATHMANDU, Aug 18: With many constitutional posts becoming vacant in the near future, the government is mulling to introduce an ordinance that would allow the government to skip mandatory hearing in parliament for appointment in the constitutional posts.



According to a high-ranking official at the law ministry, the draft of the ordinance has been prepared and will be forwarded for approval to the cabinet as early as possible. [break]



"The proposed ordinance will pave the way for appointments in the constitutional bodies without conducting any parliamentary hearing. As per the draft ordinance, the appointments will be endorsed within 30 days after the parliamentary election," said the official on condition of anonymity.

 

Article 155 (1) of the Interim Constitution states: “prior to the appointment of any persons to constitutional positions to which appointments are made on the recommendation of the Constitutional Council pursuant to this constitution, to positions of judges of the Supreme Court and to the positions of ambassadors, there shall be parliamentary hearing about them as provided in the law.”



The chief justice makes appointments in the judicial bodies on the recommendation of the Judicial Council while the president makes appointments in constitutional bodies on the recommendation of the Constitutional Council.



The Commission for the Investigation of Abuse of Authority (CIAA) is without its chief while the positions of commissioners at the Election Commission (EC) will become vacant after mid-December. The government has also failed to appoint judges in the apex court due to absence of parliament.
