JC suspends judge for misconduct

KATHMANDU, Oct 25: The Judicial Council (JC) on Monday suspended Pokhara Appellate Court Judge Om Prakash Subedi over his misconduct with women and absence from the court without notification.



The JC, the only authorized body to investigate and take action against judges, decided not to allow Judge Subedi to carry out his official duties until the completion of an investigation against him.[break]



The JC had formed a probe committee led by Supreme Court Justice Top Bahadur Magar to investigate Judge Subedi.



"The JC decided on moral grounds to ban Judge Subedi from conducting his duties, as recommended by a report prepared by Supreme Court (SC) Justice Balram KC," said Nahakul Subedi, spokesperson at the JC.



An investigation by SC Justice KC had concluded that Subedi, while serving at Pokhara Appellate Court, was absent for about a month without permission from the chief judge.



There were two complaints against Subedi concerning his absence. According to the report, Subedi had remained absent for long while serving at Tulsipur Appellate Court also, without the approval of the senior judge.



Subedi was later transferred to Pokhara Appellate Court. And in Pokhara also, Subedi went on leave for a long period without prior consent from the chief judge of the court, states the report.



The JC had also received complaints regarding Judge Subedi´s extramarital affairs. "He has been banned from discharging his duties because questions were also raised over his extramarital relations," the JC decision further states.



The JC had asked Judge Subedi to furnish clarifications why he remained absent for long without informing his seniors.



"The clarifications furnished by Judge Subedi were not satisfactory," reads the decision paper.



He had also made ´negative´ remarks about Constituent Assembly members recently. He had appealed to the public not to show respect to CA members, citing their failure to promulgate a new constitution.
