Supreme Court Bar against the election of former CJ as President or Vice President

KATHMANDU, Feb 23: The Supreme Court Bar Association has drawn the attention of the Election Commission (EC) to stop the election of any former Chief Justices or Justices from contesting for the post of the President or the Vice President of the country.

Speaking at a press meet held on Wednesday, Supreme Court Bar Association President Harishankar Niraula said the Election Commission will be reminded of the provisions in the constitution and the law that disqualifies former Chief Justice or Justice from standing as the President or the Vice President.

Furthermore, Sections 11 and 12 of the Act relating to the Election of President and Vice President, 2074, provides that only a person who does not hold a position of benefit and who does not draw economic benefit from the government can be a candidate for President or Vice President.

The SC Bar Association also decided to request the Constitutional Council to proceed with the process for the appointment of the Chief Justice and justices in the Supreme Court without further delay.
