The chargesheet says, "Investigation revealed that, the note written by the deceased Jiah Khan establishes that the accused Sooraj Pancholi ruined her life... the willful conduct of the accused drove the deceased to commit suicide. Hence the accused is liable for his actions to be punished for the willful conduct and abetment to suicide."The CBI chargesheet, that includes letters between Sooraj Pancholi and Jiah Khan, says one of the reasons for Jiah going into depression was an abortion at home.
"Suraj Pancholi called Dr R Sharma (name changed to protect identity) and told that he helped her to pull out the remaining stuff (i.e., foetus,)" the chargesheet, filed two days ago in a special court, said.
Jiah Khan in one of her letters to Sooraj Pancholi said, "I was scared of getting pregnant but I gave you myself completely. The pain you have caused me every day has destroyed every bit of me, destroyed my soul and I aborted our baby when it hurt me deeply."
The chargesheet alleges physical abuse by Sooraj Pancholi, and also says Jiah Khan was under the influence of ethyl alcohol at the time of committing suicide.
The CBI says a three-page suicide note was written by Jiah Khan in which she has narrated her intimate relationship with Sooraj Pancholi, the physical abuse, mental and physical torture she underwent.
"Though the note is not signed by Jiah or addressed to Sooraj, evidences on hand suggested that this incriminates Sooraj only," the chargesheet says.
Sooraj Pancholi's father Aditya Pancholi told NDTV, "It is their word against ours. The letters which were found in Jiah's house are not addressed to Sooraj. There is no date and no time on the letter. We are going to fight this in Court."
Sooraj Pancholi, who was present in court, says the truth would eventually come out.
Jiah Khan, who had started in films like Nishabd and Ghajini alongside Amitabh Bachchan and Aamir Khan was found hanging in her Juhu apartment on June 3, 2013.
