SC terms government reply on Karki's appointment 'irresponsible'

KATHMANDU, Sept 16: The Supreme Court (SC) Friday termed the government response to the court's order for submitting documents related to the appointment of Chief of the Commission for the Investigation of Abuse of Authority (CIAA) 'irresponsible'. 

A division bench led by Chief Justice Sushila Karki comprising justices Bishwambhar Shrestha and Sapana Pradhan Malla Friday concluded that the government reply stating that the original documents related to CIAA Chief' Karki's appointment were lost during the earthquake was irresponsible and unconvincing. 

The court has forewarned of action on the appointment case in accordance with the Judicial Administration Act- 2073 BS if the documents were not presented before it within a week. 
It may be noted that earlier the government sent a reply in writing stating that documents related to Karki's appointment lost while transferring documents in the aftermath of the earthquake. 

Advocate Om Prakash Aryal on May 12, 2013 had moved the apex court, challenging Karki's appointment as the CIAA Chief. A writ petition filed by him stated that an incompetent individual was appointed to the post of CIAA Chief. 

Later on September 24, 2014, the court quashed the writ. Advocate Aryal again visited the court, seeking a review of its September 24 decision and acting on the appeal filed by Aryal, the SC had sought original documents related to Karki's appointment. RSS
