SC stays minister Mahat's decision

KATHMANDU, August 20: The Supreme Court (SC) on Friday stayed the decision of energy minister Prakash Sharan Mahat to revoke the appointment of Arjun Karki as Head of Upper Tamakoshi Hydroelectric Project until the next decision of the Apex Court on the matter.



A single bench of SC Justice Rana Bahadur Bam issued the order stating that the minister´s decision to revoke Karki´s appointment was not appropriate. The bench, however, said it will decide whether to continue the stay order after a detailed hearing on the writ petition.



The bench has also summoned government authorities and writ petitioners for a detailed hearing on whether to continue stay order. Karki, himself had filed a writ petition at the SC on Thursday saying that the minister´s decision to revoke his appointment was unlawful and unofficial. "Minister´s decision has sent a wrong message that the potential hydroelectric project like Upper Tamakoshi cannot be undertaken through domestic investment," Karki said in his petition.



Karki´s appointment was dragged into controversy after Minister Mahat revoked it, a decision taken by the ministry´s energy secretary Shankar Koirala. Mahat had also sought clarification with Koirala over the Karki´s appointment.
