SC stays govt decision to appoint Gautam as National Assembly member

KATHMANDU, Sept 23: The Supreme Court has stayed the appointment of Vice Chairman of the ruling Nepal Communist Party (NCP) Bam Dev Gautam as a member of National Assembly.

A single bench of justice Ananda Mohan Bhattarai on Wednesday issued an interim order, asking the government not to entrust Gautam with the responsibility as a member of the upper house of the federal parliament.

The apex court has also summoned the government authorities concerned for further discussion whether to continue the stay order. Raising a serious constitutional and ethical question to appoint as a lawmaker to the one defeated in the parliamentary election, the court also referred this case to the constitutional bench for hearing on September 30.

Amid widespread public criticisms over the move of the government to appoint those defeated in the parliament election as a member of the federal parliament, senior advocate Dinesh Tripathi registered a writ petition at the apex court on Monday, demanding its ruling to bar Gautam from discharging duties as a lawmaker. The petitioner argued that it was against the constitutional provisions to appoint someone defeated in the parliamentary election to give a cabinet berth.
