A special bench of justices Kalyan Shrestha, Sushila Karki and Girish Chandra Lal, on Thursday, ordered the government to make necessary arrangements to issue driving license also to people with hearing impairment if they pass the driving test.[break]
Justices Shrestha, Karki and Lal were responding to a writ petition filed at SC by three people including former lawmaker Raghavbir Joshi.
According to Clause 47 (e) of the Motor Vehicles and Transport Management Act, 1993, a person who is as deaf or is not able to hear normally is deemed ineligible for a driving license.
The apex court has ordered the government to make necessary amendments, including other physical and managerial aspects, to the Motor Vehicles and Transport Management Act, 1993 within one year and pave the way for people with hearing impairment to acquire driving license.
The SC order has also stressed on formulating a work plan on developing necessary infrastructures and upgrading roads and traffic management system, among other issues.
The writ petitioners had demanded that Clause 47 (e) of the Motor Vehicles and Transport Management Act, 1993, be scrapped arguing that it is against the right to equality.
