SC orders registration of writ petition against Home Minister Lamichhane and Attorney General Dr. Pokharel

KATHMANDU, May 22 – The Supreme Court (SC) has ordered its administration to register the writ petition filed against Deputy Prime Minister and Home Minister Rabi Lamichhane and Attorney General Dr. Din Mani Pokharel.

A single bench of Justice Tek Prasad Dhungana quashed the earlier order refusing to register the writ petition submitted by Advocate Anupam Bhattarai against Home Minister Lamichhane and Attorney General Dr. Pokharel.

Following this order from the apex court, the writ petition submitted by Advocate Bhattarai will be registered at the SC for hearing. Earlier, the SC administration had refused to register the petition.

Advocate Bhattarai submitted a writ petition to the SC questioning the validity of the letter issued by the Office of the Attorney General in the name of Home Minister Lamichhane.

Bhattarai demanded that the letter issued by the Office of the Attorney General be revoked, arguing that the practice of issuing such letters by the Office of the Attorney General based on whether an investigation has been conducted by subordinate units in response to an application filed by any individual could be misused.

He also demanded that an order be issued in the name of the Office of the Attorney General not to issue such letters in the future.

Arguing that Lamichhane's position as Home Minister hinders a cooperative investigation against him, Advocate Bhattarai further demanded an order to remove him from his post or suspend him as soon as the investigation into the cases proceeds.

Since Thursday is a public holiday, the writ petition is likely to be registered on Friday following Wednesday’s order from the SC
