The writ petition was filed by Bipin Dhakal against the commission, naming the Office of the Prime Minister and Council of Ministers (OPMCM) at Singha Durbar as one of the respondents. The petition claims the commission is biased and not neutral regarding the subject matter.

The SC stated that although an interim order was requested, the issue requires a full hearing before determining whether such an order should be issued. Therefore, an interim order has not been granted at this stage.

The commission under scrutiny was formed to investigate violence and arson during the Gen Z movement and is chaired by Gauri Bahadur Karki, with members Bigyan Raj Sharma and Bishweshwar Prasad Bhandari.
