A division bench of Justices Sushila Karki and Gopal Parajuli stated that the issues raised on the petition would be addressed in a verdict to be issued later and that an interim order on the matter was uncalled for at the moment.
The apex court denial has paved the way for the government agencies to execute the decision banning poly bags from the valley.
Nepal Plastic Manufacturers' Association and its member industries had moved Supreme Court after the government decided to ban polythene bags in the Kathmandu Valley from April 14, the first day of Nepali Year 2072.
The government had directed the concerned authorities to enforce the ban on the use of plastic bags after the Environment Committee of the parliament had directed the government to do so.
The committee had also asked the government to amend the Plastic Bags (Regulation and Control) Directives to prohibit plastic factories from manufacturing bags below 30 microns in thickness.
Nepal Plastic Manufacturers' Association had moved the apex court claiming that the ban was enforced without any proper scientific study and it would hurt their business. They have named the Office of Prime Minister and Council of Ministers, the Environment Committee of the parliament and the Ministry of Science, Technology and Environment as defendants.
