KATHMANDU, Jan 20: Justice Anil Kumar Sinha, who is also a member of five-member constitutional bench, said on Wednesday that the remarks being made by Prime Minister K P Oli, leaders of various political parties and civil society groups on the move of the prime minister to dissolve the House of Representatives(HoR) won’t influence their verdict on the matter. 

While pleading on behalf of the petitioners who have demanded reinstatement of the dissolved parliament, advocate Kanchan Krishna Neupane raised the question that the PM Oli has been assuring the public that the dissolved lower house of the federal parliament won’t be reinstated in any case. “Will this not influence the case which is sub judice in the apex court?” he had asked. 

Responding to his question, Justice Sinha said that the apex court will not be influenced by any such remarks being made by the prime minister, leaders of various political parties and civil society groups.

Following the dissolution of HoR by President Bidya Devi Bhandari at the recommendation of Prime Minister Oli on December 20, lawmakers of the dissolved parliament and leaders across political parties have been giving their views on the case of the house dissolution.

While the ruling NCP faction led by Prime Minister Oli has been backing the house dissolution and appealing to the general public to actively participate in midterm elections scheduled for April 30 and May 10, the rival faction of the same party led by Puspha Kamal Dahal and Madhav Kumar Nepal has been calling for the restoration of lower house of the parliament, terming the government’s move unconstitutional.

The hearing on the writ petitions filed against the dissolution of HoR is currently sub judice in the Supreme Court. The five-member constitutional bench led by Chief Justice Cholendra SJB Rana is conducting hearings on the case on a daily basis.
