The Speaker´s move follows a similar writ petition by Prime Minister Dr Baburam Bhattarai two days ago.[break]
In his application, the speaker, who is also a lawyer, has argued that the Judicial Administration Act has not specified that a verdict passed by a particular bench can be reviewed and a verdict of another bench cannot be reviewed.
"The court administration´s decision has constricted the jurisdication of the apex court," the speaker has argued in the petition filed through the Office of the Attorney General, adding "The authority to decide whether a particular verdict can be reviewed or not lies in the bench and not in the administration."
While seeking nullification of the December 28 decision of the court administration, the prime minister and speaker had stated that the decision violated the existing Judicial Administration Law and asked the court to direct the administration to register the review petition.
In December, the speaker had moved the apex court with a petition seeking revision of the November 28 verdict that said the CA term can be extended upto six months for one last time.
Now the petitions of the prime minister and speaker will be presented before a single bench that will decide whether to uphold the court administration´s rejection or direct the administration to accept the review petitions.
In the meantime, Hemanta Rawal, co-spokesperson of the Supreme Court, said that the court is likely to conduct hearing on the applications Wednesday.
