Maoist commander released

NEPALGUNJ, Dec 4: Maoist brigade commander Dipendra Bahadur Shahi, who was arrested last Saturday and sent to district prison by the District Administration Office (DAO) for three months, was released on Friday following a court order.



Shahi was released after Appellate Court Nepalgunj ordered his release responding to a habeas corpus writ petition.



Shahi, who was in possession of a Chinese pistol with UNMIN sticker and was engaged in a brawl with locals in Kohalpur when he was arrested, was sent to prison by the DAO five days ago under the Public Security Act. According to the DAO, he had produced a pistol when the police asked for his identity.



Maoist worker and lawyer Tirtha Gyawali has filed a petition at the court stating that Shahi´s prison sentence was illegal. A joint bench of chief judge Hariram Koirala and judge Tanka Bahadur Moktan ordered Shahi´s release stating he cannot be kept in jail.



Shahi was in Kohalpur to visit his wife. Shahi is the commander of the Mangalsen Smriti brigade under the Maoist fifth division in Rolpa.
