Legalize Same Sex Marriage

Marriage, both ubiquitous and prime institution of human life, is indeed a way down the pursuit of happiness, which is subjective towards individual dispositions, tendencies and hesitations. But, whom we prudentially choose to marry is determined by our sexual nature, and not rationale. As such, restricting same-sex marriage is against the fundamental rights of LGBTQ community. While the LGBTQ people have meager probability of marrying as per their religious group, they are similarly discriminated from marrying legally.

Nuptial bond is regarded as a means of procreation or rather continuity of human race, but it should be considered that even when heterogamous couples are regarded married even if they cannot conceive any child. In legal sense, marriage certification by the state is instrumental for social, economic and political recognition of the marriage. As it is evident that marriage is not solely aimed at procreation, same-sex marriage should be legalized in Nepal, just like it has been practiced in many countries worldwide.

The institution of marriage dwells through sexual intimacy, friendly companionship, romantic interaction, procreation and mutual prudential co-operation in the walks of life. As any individual from LGBTQ community can fulfill these aspects of marriage, all states should seriously consider legalizing same-sex marriage. The most wide-spread superstition that same-sex marriage is immoral and unnatural can be uprooted by legality provided by the states. That asserted the main rationale behind state-sanctified marriage should not be only procreation.

Just like in same-sex marriage there are always few tiptoes in traditional marriages as well. However, the existence of heterosexual creeps did not translate to restriction of such marriage by the state. That is why, every couple needs to be endowed with ‘right to marry’ as long as they have consensual understanding. The state should also offer civil benefits, along with status and dignity that entail from legal recognition of marriage to all married couples without discrimination on the grounds of homosexuality.

While incidences of immoral marriages like child marriage, polygamy, incestuous marriage, women violence and marriage bondage are still not properly checked and disapproved with sanctions against perpetrators; it is illogical for Nepalese Government to try to regulate homo-sexuality. The benefits and risks of granting legal recognition to same-sex marriage are concomitant to any other forms of marriage. The state should consider the freedom and right to equality of its citizens, rather that forbidding natural phenomenon like homosexuality which might have been feebly supported by a strong public interest.

From yet another perspective, all adults have a right to decide whom to marry. This right has both natural and emotional significance. Being homosexual is not a choice, but necessity for LGBTQ community. That is why it is unfair to discriminate homosexuals as they do not have any control over what they desire. As we, heterosexuals, did not choose to be straight; we should not torment the homosexuals who did not choose to be that way. Let’s lobby for legalization of same-sex marriage for once and all, and offer status and dignity to LGBTQ community.
