Defense Ministry questions court order

KATHMANDU, May 12: The Defense Ministry on Tuesday questioned the Supreme Court´s decision on the continuation of the March-24 stay order on the retirement of eight brigadier generals of Nepal Army.



On Sunday, the apex court continued the stay order saying that the government pensioned off the brigadier generals without giving due reasons.



The ministry, however, said there is no law that categorically requires the government to give reasons to the persons whom the government pensions off.



The ministry communicated its reservation to the Sunday order in a written reply to the apex court on Tuesday.



The automatic retirement to the generals in itself is the reason behind the government´s decision, said Acting Secretary Ganesh Raj Joshi.



Joshi also argued that the government´s decision to get rid of the eight brigadier generals can´t be a subject matter of judicial review, while pleading to quash the writ petition filed by the eight brigadier generals against their retirement.
