Dahal points out flaws in new constitution

KATHMANDU, Dec 3: UCPN (Maoist) Chairman Pushpa Kamal Dahal, presenting a political paper Tuesday, pointed out some flaws of the new constitution.

He expressed some dissatisfaction over the proposed federal boundaries, the form of governance and the proposed provisions for a proportional inclusive system.


Dahal has criticized the top leadership of the two major ruling parties in the former government for their rigidity in not carving out the provinces on the basis of identity and economic viability. "The interests of some political leaders in including particular districts, constituencies or areas within a given province rather than following a certain policy and theory has resulted in greater complexity in federalism and imbalance between the federal structures," reads Dahal's political paper presented at the party central committee meeting on Tuesday.

The UCPN (Maoist) central committee meeting is scheduled to start deliberations on Dahal's political paper from Thursday. Dahal further explained that the UCPN (Maoist) had differing views on the proposed delineation of provinces.

Stating that continuation of the parliamentary system even after the historic changes in the country was a mistake, Dahal insisted on the necessity of a directly-elected executive system in the country.

Criticizing the structure of the judiciary in the new constitution, the Maoist chief stated that the existing provisions on the judiciary would not make people feel the difference under federalism.

Dahal admits that the inclusiveness policy in the new constitution without proportionality has weakened the constitution. He further stressed that such weaknesses should be corrected by amending the constitution at the earliest.

In his political paper, Dahal has identified weak points in the citizenship provisions, the rights of Dalits and women, and the rights of farmers and laborers, among other issues. He has also stressed on endorsing through parliament any agreement with foreign institutions on the uses of natural and water resources.

However, Dahal also spent a lot of words praising the achievements of the new constitution. He maintains that institutionalization of republic, federalism and secularism and the flexibility of the new constitution are its major achievements.

'Political task of peace process has concluded'

The chief of the former rebel party, in his political paper, draws the conclution that the major political task of the peace process has been completed with the promulgation of the new constitution. "With the promulgation of the new constitution the main political task of the peace process has concluded. But it may take time to conclude some tasks concerning transitional justice," reads page 13 of Dahal's paper.

UCPN (Maoist) has expressed dissatisfaction over some provisions in the new constitution concerning the transitional justice mechanism.
