Yadav was the parliamentary first-past-the-post candidate from CPN (Maoist Center). The EC had annulled his candidacy citing that a passport forgery case in which Yadav was involved in is still pending at the Special Court.

Claiming that EC's decision violated his fundamental right, he has sought an interim order from the apex court to stay the decision. The EC, District Election Office Sarlahi and Ganesh Prasad Singh who had challenged his candidacy have been made defendants in the writ petition.
