The leaders reached an agreement to this effect at a meeting of the high-level taskforce on Sunday while delving into the disputes in the preliminary draft report prepared by the Constituent Assembly´s (CA) thematic committee on determining fundamental rights and directive principles.[break]
They, however, agreed that the state should have the power to impose reasonable restrictions on any act that may undermine the sovereignty and integrity of the country, or which may jeopardize the harmonious relations among the peoples of various castes, tribes, religions or communities and among the federal units. Likewise, they also agreed that the state can impose restrictions on any act that may incite violence or be contrary to public morality.
"We at the meeting today [Sunday] decided to remove the differing views and endorse the provision passed by the majority in the thematic committee," UML leader Bharatmohan Adhikari told reporters after the taskforce meeting.
While preparing the thematic draft, the UCPN (Maoist) and Nepali Congress (NC) lawmakers had registered their differing views on the provision. "There should be a reasonable restriction on any political party involved in treason, working as foreign stooge, conspiring against the country and involved in regressive activities," said the differing view registered by the Maoists.
The NC lawmakers had filed their differing views as well. "Any party that is against multi-party system based on pluralism and tries to establish totalitarian regime, one-party dictatorship, establishes military or paramilitary structures, launches insurgency against the state and works against the principles of human rights should be banned," read the differing view registered by the NC lawmakers.
The agreement was reached after leaders from both the UCPN (Maoist) and the NC agreed to withdraw their differing views.
Though the members of the taskforce also discussed if there should be retroactive laws, they failed to reach any agreement. Likewise, the leaders also couldn´t settle the dispute related to fixing ceiling on private property, land reforms and other related issues including compensation to landlords while acquiring their land.
The taskforce, which is headed by Maoist Chairman Pushpa Kamal Dahal, had earlier resolved around 40 disputes in the statute drafting process. NC and UML parliamentary party leaders Ram Chandra Paudel and Jhalanath Khanal respectively, among others, are members of the taskforce.
