A division bench comprising judges Narayan Prasad Paudel, Dilliratna Shrestha and Bidur Koirala issued the order on Wednesday. Dr Mishra had earlier resigned from her post as additional secretary amid speculation that she would be appointed health minister in the current government led by Sushila Karki. However, despite being recommended for the post, she was not appointed as the corruption case remained sub judice.
Earlier, the Cabinet meeting held on March 6 appointed Dr Bikas Devkota as secretary in her place, a decision that drew controversy after a seniority principle was reportedly overlooked.
