Adhikari couple has been admitted in the intensive care unit of Bir Hospital since more than a week after their health condition deteriorated. They have been on fast-unto-death for over a month demanding action against those involved in the murder of their son Krishna Prasad Adhikari. He had died at the hands of Maoists during the insurgency.
The writ petitioner has urged the SC to issue a mandamus arguing that the government did not interfere with the hunger strike of Adhikari couple though their health condition has been deteriorating.
Shiwakoti has maintained that the apex court should issue an order on investigating into murder of Adhikari couple´s son stating that the present government has not taken no concrete action to safeguard the lives of Nanda Prasad and Ganga Maya Adhikari apart from urging the couple to end their hunger strike.
The writ petitioner has argued that there should be judicial interference as the hunger strike of Adhikari couple has been prolonging because of indifference of the government and the police.
Though various rights activists and political leaders are repeatedly urging Adhikari couple to end their hunger strike, the couple has reiterated that they would not consider the option until justice is delivered.
Chairman of the Interim Election Council Khil Raj Regmi and his office, National Human Rights Commission (NHRC), office of the attorney general, the police headquarter and Ministry of Health and Population, among others, are named as defendants in the writ petition.
