KATHMANDU, Jan 21: The Supreme Court (SC) has refused to issue an interim order to halt the Election Commission’s (EC) decision recognizing the executive committee of the Nepali Congress (NC) led by President Gagan Thapa.
Party President Thapa and the new members of the NC was unanimously elected by the January 11-14 Special General Convention. Following which, the EC had granted the legality of the party to Thapa-led Congress. Against which the establishment faction had moved to the SC.

Hearing a writ petition challenging the EC’s decision, the court declined to issue an immediate stay and instead summoned both parties for further discussion. The order was issued on Tuesday by a single bench of Justice Sunil Kumar Pokharel.
The decision has cleared the way for the Thapa-led executive committee to continue functioning. Former party president Sher Bahadur Deuba and acting president Purna Bahadur Khadka had filed the writ, claiming the committee elected through the special convention was illegitimate.
During the hearing, lawyers representing the petitioners argued that the executive committee should be dissolved.
