NBA accuses SC administration of obstructing justice through ‘silence’

KATHMANDU, May 13: Nepal Bar Association (NBA) has accused the administration of the Supreme Court (SC) of obstructing the delivery of justice by maintaining “silence” instead of making decisions on the registration or rejection of cases.



In a statement issued on Wednesday, the NBA expressed serious concern that the constitutional right of citizens to justice was being affected after court administration officials allegedly withheld files instead of providing legal remedies to writ petitions submitted before the court.

The statement, signed by General Secretary and senior advocate Kedar Prasad Koirala, said that in recent days, petitions submitted for registration at the SC were initially rejected by the administration, and when applicants challenged those decisions before the bench, the concerned branches allegedly failed to move the process forward and instead kept the files pending.


The NBA stated that institutions like the court must always function in an open, transparent, and impartial manner, adding that delays even in registering petitions at an institution regarded as the temple of justice were deeply concerning.


The NBA warned that such practices could weaken public trust in judicial administration and said the evolving situation had compelled it to play a more active and responsible role.


Reaffirming its commitment to protecting constitutional supremacy, the rule of law, and the principle of separation of powers, the association urged the concerned authorities to ensure that constitutional rights and access to justice are not obstructed and to immediately resolve petitions related to administrative rejection of filings in order to maintain public confidence in judicial administration.
