Justices Bharat Raj Upreti, Baidyanath Upadhyay, Tark Raj Bhatta, Gyanendra Bahadur Karki, Dr Bharat Bahadur Karki and Kamal Narayan Das who were appointed for two years had their term expired today. [break]
The Judicial Council meeting on Tuesday failed to take any decision for the re-appointment of temporary justices, citing the need of new legislation for this thereby compelling the five justices to leave the court.
The daily case list maintained at the SC website deleted the names of all five justice but their names and photos are still in place.
The meeting of the Council was held at the residence of the Prime Minister as he is taking charge of the Law Ministry too.
The SC with ten benches often runs single, division and full benches, adding more than 300 cases and writ petitions in a day.
Justice Bhatta is retiring on age limit while Upadhyay and Karki would return to the appellate courts from where they were brought to the SC.
Justices Upreti and Dr Karki and Das had entered the SC from teaching and legal practice.
If law sees no change, another temporary justice Prakash Wasti too will retire within a month.
However, the Judicial Council says necessary law was likely to be passed within three days in the form of an Ordinance because no parliamentary hearing was needed for this.
