Special Court accepts bank guarantee for Kansakar's release

KATHMANDU, March 5: After five days in judicial custody, Nepal Airlines Corporation (NAC)´s suspended Executive Chairman Sugat Ratna Kansakar, was released on Friday after the Special Court accepted a bank guarantee for the bail amount of Rs 60 million.



Narayan Das Manandhar, CEO of the Prime Commercial Bank, signed the bank guarantee on behalf of Kansakar. Earlier, Kansakar had been sent to judicial custody as he had failed to pay the bail amount. [break]



“We produced bank guarantee before the Special Court as per the Procedural Directive on Deposit and Bank Guarantee issued by the Supreme Court (SC),” said Kansakar´s lawyer Subash Acharya, adding, “The Special Court´s acceptance of the bank guarantee paved the way for Kansakar´s release.”



On the same day, the Airbus Company also refunded the lock up (also known as non-refundable commitment money) money sent by NAC through account number 00300406330048 of the Himalayan Bank.



Asked if refund of the lock-up money had anything to do with Kansakar´s release, Special Court Registrar Dhir Bahadur Chand said, “The incidents have no connection. We accepted the bank guarantee as the Supreme Court has set such a precedent.”



This is the first ever instance that a defendant has been released on the basis of a bank guarantee. “As far as I know, this is the first ever instance that a court in Nepal has accepted such a document,” Chand added.



Kansakar, who had been absconding after the Commission for the Investigation of Abuse of Authority (CIAA) filed a graft case against him, had appeared during the hearing on the case on Sunday.



Accusing Kansakar and five others officials of sending Rs 57.3 million lock-up money to the Airbus Company in violation of the Public Procurement Act, the CIAA had filed a case against them at the Special Court on December 25.



The Special Court had summoned Kansakar on February 14 to appear before the court but he didn´t show up.



Following Kansakar´s release, the Special Court has also set a hearing date on the corruption case. “The court will hold hearing on the case on Sunday,” Chand informed Republica.



Including Kansakar, CIAA had filed corruption case against acting assistant general managers Raju Bahadur KC and Ganesh Thakur, Acting Director Gyanendra Purush Dhakal, Director Mayur Sumsher Rana and Acting Deputy Director Keshav Raj Sharma.
