Sah had moved the Supreme Court on January 18, 2015 challenging the decision of Janakpur Appellate Court that upheld the order of Dhanusha District Court to send Sah to judicial custody. After police charge-sheeted Sah as the prime accused in the bomb blast, the Dhanusha District Court on May 8, 2014 had sent Sah to judicial custody.A division bench of Justice Deepak Raj Joshi and Jagadish Sharma Paudel on June 17 had ordered the district court to furnish the documents relating to the case at the Supreme Court bench. Five people were killed in the bomb blast in Janakpur on May 1, 2011. Police had arrested Sah in April 2014 as Mukesh Chaudhary mitted having planted the bomb and revealed Sah to have masterminded the blast.
Illegal arms possession case against Sah pending at SC
Meanwhile, a case of illegal arms possession against Sah is pending at the Supreme Court for years.
Sah, who was accused of carrying a 9 MM pistol and terrorizing locals at Sakhuwa Mahendranagar of Dhanusha on May 17, 2003, was handed a one-year a jail term of one year and nine months by the District Administration Office in 2004. Janakpur Appellate Court had upheld the decision of the DAO.
Sah had challenged the Appellate Court verdict of June 13, 2006. On June 7, 2011, a division bench of Justices Abadhes Kumar Yadav and Kamal Narayan Das suggested that the case be taken up by full bench after the two held contradictory views in the case. However, the case is still pending at the apex court.
